Updating Your Terms of Service for A2P SMS Approval
In addition to your Privacy Policy, mobile carriers require your Terms of Service (ToS) to include specific language regarding your SMS program. This ensures that clients understand what they are signing up for and how to stop receiving messages.
Without these specific clauses, your A2P Brand application will be rejected.
1. The Mandatory SMS Clause
To meet compliance, you must add a specific section to your Terms of Service. Copy and paste this exact block (heading and text), replacing the bracketed information with your clinic's details:
SMS/Text Messaging Program
[Legal Clinic Name] provides appointment reminders, follow-up notifications, and clinic updates via SMS. By opting in, you agree to receive these communications. You can cancel the SMS service at any time; just text "STOP" to our phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time. If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at [Clinic Email Address] and [Clinic Phone Number]. Message frequency may vary. Message and data rates may apply for any messages sent to you from us and to us from you. Carriers are not liable for delayed or undelivered messages. 2. Requirements for All Clinics
- Information Match: Your Business Name, Email, and Phone Number in the Terms of Service must match exactly what was submitted in your A2P Brand Registration.
- Privacy Policy Link: Your Terms of Service must include a direct, clickable link to your Privacy Policy.
- Footer Accessibility: Like the Privacy Policy, a link to your Terms of Service must be visible in the footer of every page on your website.
3. If You Don't Have a Terms of Service Page Yet
If your clinic does not currently have a Terms of Service page, you can use this Sample Terms of Service Template as a starting point, but please be aware that this is a generic sample only and may not be sufficient for your specific legal or regulatory requirements.
